By creating an account or using Daily Kick ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Daily Kick is a web application that allows you to set personal goals and receive a daily AI-generated motivational message (a "Kick") designed to help you stay on track. Messages are generated by the Anthropic Claude AI and delivered to your email and in-app inbox.
The Service is currently provided free of charge, with a paid "Pro" tier planned for the future. We reserve the right to change, suspend, or discontinue any part of the Service at any time.
3. User Accounts
- You must provide accurate, current, and complete information when creating your account.
- You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
- You must be at least 13 years old to use this Service.
- One account per person. Creating multiple accounts to circumvent Free tier limits is not permitted.
4. User Responsibilities
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Submit content designed to generate harmful, abusive, or discriminatory AI output.
- Attempt to probe, scan, or test the vulnerability of the Service or bypass any security measures.
- Interfere with or disrupt the integrity or performance of the Service.
- Reverse-engineer or attempt to extract the source code of the Service.
5. Free and Pro Tiers
Daily Kick currently offers a free tier. A paid Pro tier with additional features (such as more goals and advanced tone preferences) is planned for the future. When a paid tier is introduced, clear pricing and billing terms will be provided before any payment is required. We will not charge you without your explicit consent.
6. AI-Generated Content & Disclaimers
Daily Kick delivers motivational messages generated by artificial intelligence. These messages are intended for general inspirational purposes only. They do not constitute professional advice — including but not limited to medical, mental health, financial, legal, or fitness advice.
AI-generated content may occasionally be inaccurate, incomplete, or not appropriate for your specific situation. You are solely responsible for how you act on any content received through the Service.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY PARTICULAR RESULT WILL BE ACHIEVED BY USING IT.
7. Intellectual Property
The Daily Kick name, logo, and application code are owned by us. The goal content and personal data you provide remain yours. By using the Service you grant us a limited licence to process your goal content solely to generate your motivational messages.
8. Termination
You may stop using the Service and delete your account at any time by contacting us at ollie@ofrost.dev.
We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice.
9. Limitation of Liability
To the maximum extent permitted by law, Daily Kick and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
